General Terms & Conditions for Service
The general terms and conditions governing the service shall be as follows:
Nomenclature:
Pine fresh Cleaning Services - Herein after referred to as "PFCS"
Client - Herein after referred to as "CLIENT"
Residential / Office / Wearhouse - herein after referred to as "PREMISES"
Whereas:
The CLIENT wishes PFCS to provide Cleaning Services at their premises and PFCS is willing to provide Cleaning Crew to the CLIENT, in exchange for a Service Fee, and the Cleaning Service will be subject to the terms and conditions as set out in this agreement.
Service Details:
1. PFCS Obligations:
1.1 Will provide cleaning crew to the Client.
1.2 PFCS crew will perform its services as mutually agreed upon by both parties.
1.3 PFCS will ensure that all the crew will have the requisite legal documentation and medical insurance, in accordance with UAE Labour Law. They will always be in the company uniform, neat, and presentable.
1.4 While PFCS crew will exercise utmost caution & care while performing their cleaning service, PFCS will not be held monetarily responsible for any unintentional / inadvertent / accidental damage that may occur to items / material / property during the course of the cleaning service.
2. CLIENT Obligations:
2.1 CLIENT will supply/provide or request PFCS to supply/provide (at an additional fee) any and all the required good quality and safe cleaning material, chemicals, consumables and equipment to carry out the cleaning services.
2.2 Provide full information for any special care and/or caution that may be required for any item.
2.3 CLIENT will ensure and take responsibility of keeping the cleaning crew work environment safe and secure in their premises at all times.
2.4 CLIENT will arrange / provide / assist for any and all gate passes required to enter the premises at their cost wherever applicable.
2.5 CLIENT will ensure that there is air conditioning, running water and electricity to be able to execute the services.
3. General:
3.1 PFCS is an independent contractor and not an employee of the CLIENT.
3.2 All work shall be finished in compliance with applicable laws and as per the best industry practice in a professional manner.
3.3 To the extent required by law, the services provided by PFCS shall be performed by individuals properly licensed and authorized by law to perform the work.
3.4 PFCS warrants that its employees are adequately insured against accidental injury.
3.5 In the event that the CLIENT fails to pay any payment due for the Service provided, PFCS may cease work subject to settlement of pending payment or resolution of a dispute. This shall not constitute breach of Contract, by PFCS.
3.6 PFCS shall not be liable for any delay due to circumstances beyond its control, and all acts of God.
3.7 PFCS hereby agrees to maintain confidentiality regarding the CLIENT's premises and to refrain from releasing any information that is not openly known to the public.
4. Payment:
4.1 Payment can be made in cash, or by cheque or bank transfer.
4.2 Payment can be made per visit or monthly, as convenient to the CLIENT as mutually agreed in writing.
4.3 Payments for "Per Visit" Service Charges, shall be payable immediately on completion of visit.
4.4 For monthly payment, an invoice will be generated on the second last day of the month and sent out by email which shall be cleared within 5 days from the date of the invoice.
5. Cancellation:
5.1 If the CLIENT would like to cancel the booking / service, PFCS needs to be informed in writing (SMS / Whatsapp / Email) at least 24 hours in advance.
5.2 If the cleaning crew reach the premises and the CLIENT is not available or no access to the premises is provided, CLIENT will be charged 100% (One Hundred Percent) for bookings 4 hours and below and 60% (sixty percent) for bookings 5 hours and above of the booking/service fee.
6. Governing Law:
This Service Agreement shall be governed and interpreted in accordance by the local & federal laws of the Emirates of Dubai - UAE and shall be subject to the exclusive jurisdiction of the courts of Dubai. In the event of disputes arising out of or in connection with this Service Agreement, both parties will try their utmost to settle the differences or disputes in an amicable manner.
